Terms of Service

These Terms of Service ("Terms") govern your use of the SpeakToCode desktop application and speaktocode.ai website (the "Service") provided by UseKase.ai ("we," "our," or "us").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

SpeakToCode is a desktop application for Windows that provides voice-to-text dictation using local AI transcription. The Service includes:

  • The SpeakToCode desktop application
  • The speaktocode.ai website and web dashboard
  • Cloud sync features (optional)
  • Customer support

2. Accounts

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activity that occurs under your account.

3. Free Trial

  • New users receive a 15-day free trial with full access to Pro features.
  • No credit card is required for the trial.
  • The trial period begins when you first install and run the application.
  • After the trial ends, you must subscribe to continue using Pro features.

4. Subscriptions and Payments

  • Paid subscriptions are billed monthly or annually via Stripe.
  • Prices are listed on our pricing page and may change with 30 days' notice.
  • Current plans: Individual ($7/month, 1 seat), Team ($29/month, 5 seats).
  • Subscriptions auto-renew unless canceled before the end of the billing period.
  • You may cancel at any time through your account settings or by contacting support.
  • Refunds are available within 14 days of initial purchase if you have not substantially used the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Reverse engineer, decompile, or disassemble the desktop application
  • Distribute, sublicense, or resell the Service
  • Attempt to circumvent usage limits or licensing restrictions
  • Use the Service to process audio content you do not have the right to process
  • Interfere with or disrupt the Service's infrastructure

6. Intellectual Property

  • SpeakToCode and its original content, features, and functionality are owned by UseKase.ai and are protected by copyright, trademark, and other intellectual property laws.
  • The SpeakToCode logo, name, and brand assets are trademarks of UseKase.ai.
  • You retain all rights to your transcription content. We do not claim ownership of text you generate using the Service.

7. Third-Party Services

The Service may integrate with third-party services:

  • Whisper AI: Open-source speech recognition by OpenAI, running locally on your device.
  • Groq API (optional): For AI text cleanup. Subject to Groq's terms of service. You provide your own API key.
  • Google/GitHub OAuth: For authentication. Subject to their respective terms.
  • Stripe: For payment processing. Subject to Stripe's terms of service.

We are not responsible for the practices of third-party services.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy at https://speaktocode.ai/privacy, which describes how we collect and use your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Transcription results will be 100% accurate
  • The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, USEKASE.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless UseKase.ai from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

  • You may terminate your account at any time by contacting support or through your account settings.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • We will delete your data within 30 days of account closure, except as required by law.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or notice on our website at least 30 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and UseKase.ai regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver.
  • Assignment: You may not assign your rights without our consent. We may assign our rights without restriction.
